Terms of Service

The service

Advanced Sending LLC (“we”) provides a hosted platform for preparing, sending and reporting on permission-based email and SMS campaigns. These terms apply to each customer organization (“you”) and the people it authorizes to use its workspace. Use of the service means you accept them.

Accounts and access

Access is set up with us and is private. You are responsible for your users, for keeping sign-in details and provider credentials secure, and for activity in your workspace. Tell us promptly if you suspect unauthorized access.

Your data and your contacts

You own your data. You give us the right to process it to provide the service. You are responsible for the lawfulness of your contacts and messages, including having consent where the law requires it, honoring unsubscribes, and following the rules of your sending providers.

Acceptable use

You may not use the service to send messages to people who have not agreed to receive them, to send unlawful, deceptive or harmful content, to bypass suppression, consent or unsubscribe controls, to interfere with the service, or to break the law or a provider's policies. We may pause sending or suspend a workspace that puts the service, other customers or recipients at risk.

Providers and integrations

The service connects to third-party providers you choose. Their terms, limits, fees and availability are theirs, and we are not responsible for them. Provider charges are separate from your subscription.

Fees and cancellation

Fees, renewal, refunds and cancellation are described in the Billing, Renewal, Refund, and Cancellation Policy, which is part of these terms.

Privacy

Our Privacy Policy explains how we handle personal data.

Availability

We work to keep the service running but do not promise it will be uninterrupted or error free. We may change or improve features over time.

Disclaimer

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all other warranties, including fitness for a particular purpose. We do not guarantee that any message will be delivered or reach the inbox.

Limit of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages or lost profits, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.

Ending the service

You may cancel as described in the billing policy. We may suspend or end access for a breach of these terms. After the workspace ends we delete your data as described in the Privacy Policy.

Governing law and changes

These terms are governed by the laws of the State of Nevada, United States. We may update them and will post the new version here; continued use after the change means you accept it. Questions: contact@advancedsending.com.
